PAYMENT TERMS

360 PHOTO BOOTH & COLD SPARKLERS PAYMENT TERMS. 

The Rental Amount shall be paid as follows:

1.) Cancellation and Deposit: As part of this Agreement, the Party is required to pay a deposit for the 360 Photo Booth and $100 for the Cold Sparklers at the time of booking. A $100 deposit is not required for Cold Sparklers if it is an Add-On to a 360 Photo Booth Booking. The Deposit will be deducted from the booking amount. Said Deposit shall be deemed refundable if the Party terminates this agreement with at least 14 days prior to the date of the Event. Said deposit will be immediately non-refundable per bookings made with less than 14 days notice prior to the event.  After 14 days prior to the event date the deposit for the 360 Photo Booth and/or $100 deposit for the Cold Sparklers will become non-refundable and the Provider shall have no obligations to perform under this Agreement.

2.) Balance Due: The remaining balance of the Rental Amount, less any deposit will be emailed to the Party shortly after the contract is signed and is due 14 days before the agreed event date. Any party that books 14 days prior to the event, must pay the full amount within 24 hours after booking. 

 

3.) Guest fees: An additional fee will be added to the Party’s invoice based on the number of guests that are attending the event. The Party will be charged an additional guest fee if the guest range option selected is less than the total amount of guests attending the event. Guests fees are based on the following: 2-50 guests (+$0.00), 51-100 guests (+$75.00), 101-200 guests (+$125.00), 201-300 guests (+$175.00), 301+ guests (+$225.00).

 

4.) Prop fees: Basic Props are included in the ‘Spin with a Smile’ Package and ‘Black Carpet Special’ Package for the 360 Photo Booth Rental. Premium Props are only included in only the Black Carpet Special. The Party can request additional props, which may include but not limited to, specific colors or themes for a prop fee of $75. General props may be provided during the event. The Party may also provide their own props.

 

5.) Overage: Any overage in time will be billed at the rate of $300.00/hour for the ‘Spin with a Smile’ Package and $500.00/hour for the ‘Black Carpet Special’ Package. Payment for any overage in time must be paid before additional hours will be provided. If the Event ends earlier than the hours originally booked, no refund will be given.

 

6.) Rights to Photos and Videos (Media): The Party grants permission to the Provider to use any and all media generated by the 360 Photo Booth and other media taken during the Event and to be used for any purpose by the Provider (including promotional purposes). The Party hereby releases to the Provider any and all rights to any media (including photos, videos, etc.) created by the 360 Photo Booth and of the Party using the 360 Photo Booth.

 

7.) Date Changes: All denied date changes are subject to their deposit becoming non-refundable. Any date changes must be requested via email to Admin@Pivot360llc.com as soon as possible. If you have booked our services and your event date changes to an earlier date that is now within 14 days from the date change request, the Party must contact us immediately via email. The provider reserves the right to accept or deny any date change request. The possibility of accommodating a date change request is subject to availability and the execution of a new agreement to replace the original agreement. If a date change request is denied and the booking is subsequently canceled, the deposit is non-refundable, and you will receive a refund of the remaining balance paid. Order: Both parties (Party and Provider) must consent to any date change.

 

8.) Payment Guidelines: All bookings must be paid in full 14 days prior to the Event Date. Any booking made within 14 days prior to the event day must pay the deposit upon booking and will receive the contract immediately after your booking and the remaining balance invoice (less the deposit) will be emailed shortly after the contract is signed. The remaining invoice balance must be paid within the 24 hours of receipt. Bookings made within 15 days or more from the Event Date must pay the deposit upon booking and will receive the contract immediately after the deposit to confirm your booking and will receive the contract immediately after your booking and the remaining balance will be emailed shortly after the contract is signed. The remaining invoice balance invoice (less the deposit) must be paid at least 14 days before the Event Date.

 

9.) Taxes: All applicable taxes will be applied and made known at the time of signing.

10.) 360 Photo Booth/ Cold Sparkler Failure: Should the Provider fail to provide a fully operational 360 Photo Booth for the Event, the Party will be subject to a full refund. In such an event, the Party waives any claim on further consequential damages or liability. If only partial services can be provided due to conditions beyond the reasonable control of the Provider, the payments shall be amended to the hourly rate of $300.00/hour for the ‘Spin with a Smile’ Package and $500/00/hour for the ‘Black Carpet Special’ Package.  Should the Provider fail to provide a fully operational Cold Sparklers Machine, the Party will be subject to a full refund. In such an event, the Party waives any claim on further consequential damages or liability.

 

11.) Rain Dates: In the event of inclement weather, you may request to reschedule your booking for our 360 Photo Booth to a new date. All rain date requests must be submitted via email to Admin@pivot360llc.com as soon as possible prior to the original event date. Please note that the initial deposit is non-refundable and will be applied to the rescheduled date. The new date is subject to availability, and while we will make every effort to accommodate your preferred rain date, we cannot guarantee availability. Once a rain date is agreed upon, a new agreement will be executed, and both parties must consent to the new terms. If a suitable rain date cannot be agreed upon and the booking is canceled, the deposit remains non-refundable, and any additional payments made beyond the deposit will be refunded.
